Minatures games and copyright issues

Most of the models that I have seen have come from the media or from other computer games.  What about models based on artwork or actual miniatures from non-computer games (Full Thrust, B5wars, Silent Death, etc.).  Would 3D models be considered derivative works for copyright purposes? :huh:  I played miniatures games before I found out about SFC and I would like to model some of my favorite ships from these games.  I know that ADB has given permission for their creations.  Could someone who has looked into the copyright issues of models give me some information on this issue?
