This sucks
« on: April 29, 2005, 11:35:41 am »
Four years ago thi coming july I got in a car accident on my way to minnesota as I was transitioning from the army back to civilian life.  In Illinois, on I-57, as I was crossing a bridge with an on ramp, a suburban type truck towing  a minivan lost control, went into a spin, and sun around several times from the ramp lane to the left lane where I was and hit me head on.  My speed  at collision was under 10 mph, nut the entire front end of the moving truck I was driving was crushed.
A law suit ensued months later- the other guy claimed it was my fault, despite eyewitnesses and direct evidence on scene to the contrary.  This whole thing has become a long, drawn out process where I'll hear nothing for several months, or more than a year, then all of a sudden my attorney will call me and tell me somethig new is happening.  This morning, over a year after i gave clear testimonyof what happened that day, and over a year after my attorney told me that there weren't any holes in my testimony unlike the other guy, I got a call from my attorney saying that they are taking this to trial, and I have to leave in the middle of a hectic summer schedule (at the time of finals I might add) at college to drive down from Minnesota to Illinois to be there.
And people wonder why I have such a disdain and lack of repect for the "justice" system.

Thanks Stephen, but theres not really anything you can do.  They might settle out of court before thi actually goes to trial, but I have to be ready to go.  Besides, if it's gone this far, I'd ratherjust go to court than settle, just on principle.  I mean, I'd rather the two guys (i'm a third party whos being blamed, the guy who hit me is the defendant and a third guy claiming injury is the plaintiff) have to deal with going to trial on this and haveto pay full consequences, rather than settle out of court.

Countersue.  If you really have a solid testimony, and his is full of holes, you'll be able to knock him out of the water.

That's not a bad idea, except I'm sure he has nothing to sue for, so there's no real point.

However, it means that if you get him to pay the court costs and lawyer fees, he'll have to pay them instead of you...and the court has ways of enforcing itself normally.

The legal fees are covered by my insurance comapny.  My lawyer was appointed and paid for by my insurance company.  The one thng my attorney doesn't understand is why the insurance companies don't hash it out between themselves, and leave the courts out of this.

It could be a lot worse.  My parents were hit by a car while crossing the street over 5 years ago leaving them with permanent disabilities.  The driver was totally at fault (as judged by the court), there is still no settlement.  Every 6 months or so they hear "real soon now" then silence for the next 6 months.

If nothing else, perhaps Dash's suggestion will mean that any rise in your premiums will be prevented/negated because the insurance company won't have to pay out on you.

And sometimes you an get blood from a turnip. If they have the cash for a lawyer, they at least have cable television that you can deprive them of for a few decades while they pay for yours. ;)
