What are my rights?
« on: December 11, 2003, 04:58:31 am »
I was forward a link by a friend to a website the other day there.

It was run by somone who I know. On of  their  friends posts two funny pictures of me, One in the matrix poster and one in the terminator poster. I had a laugh, no harm done.

However, this same person has said they may post another pic, a photoshop special, on the site with me" @@@@in a donkey"- his words not mine.

It could be an empty threat or even a joke(I don't know this person very well)- but say they did post that image. What could i do?

I know the image was obtained (likely without permission) from my place of work in the first place.

I know the site admin- who is a reasonable guy and would prob remove something if i found it offensive, but say he refused to do anything about it.

Well I heard from the guy again- it looks like he was joking and it was throw-away comment. Hopefully it stays that way.

Had a peek at the UK assistance bureau for this kind of thing, the  UK Information Commissioner.

Basically, he is an 'information controller' and he is not exempt from the DPA of 98 since it is personal information stored for non-domestic use. (Anything on the internet is not 'domestic'.).

If he posts just the picture, then it's sort of iffy, but if he posts it with name or other personal information that makes you easily identifiable, you can ask to have it removed and he must comply or you can take legal action at the nearest county court. (You must ask first, in writing, though; keep a copy of the letter you send and any response.).
